These terms of use (“TOU”) constitute a legal agreement between you and Di Lemme Development Group, Inc., (“DDG”).  These TOU govern your use of this website and all other DDG websites and blogs including but not limited to www.ChampionsLiveFree.com, www.LifestyleFreedomClub.com, www.LifestyleFreedomClub.net. The TOU also apply to your purchase of products or services from DDG.  By accessing the website, you are indicating your acknowledgement and acceptance of the TOU. DDG reserves the right to change the TOU at any time at its discretion, without notice to you.  The latest version of the TOU can be reviewed on this page.  If you continue to use this website after DDG posts changes to these TOU, you are signifying your acceptance of the new terms. Please read this section carefully to understand the TOU.

Description of Services and Products
Through its website, DDG provides you with access to various resources, including communication and information through the website (“Information”) and the purchase of products and services.  Information, products and services are subject to the TOU.

Warranties
THIS WEBSITE IS FOR INFORMATIONAL PURPOSES ONLY.  THE INFORMATION FOUND ON THIS WEBSITE IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, AND DDG AND/OR ITS DEALERS, ASSOCIATES, AGENTS AND LICENSORS HEREBY DISCLAIM ALL WARRANTIES WITH REGARD TO INFORMATION OR PRODUCTS INCLUDING ALL WARRANTIES OF MERCHANTABILITY, WHETHER EXPRESS, IMPLIED OR STATUTORY, FITNESS FOR A PARTICULAR PURPOSE, EXPECTATIONS OF PRIVACY OR INFRINGEMENT.

DDG AND/OR ITS DEALERS, ASSOCIATES, AGENTS, LICENSORS DO NOT WARRANT THAT THE FUNCTIONS OF THIS WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS WEBSITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES. DDG AND/OR ITS DEALERS, ASSOCIATES, AGENTS, LICENSORS DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE INFORMATION IN THIS WEBSITE IN TERMS OF ITS CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.

Limitation of Liabilities
 IN NO EVENT SHALL DDG AND/OR ITS DEALERS, ASSOCIATES, AGENTS, LICENSORS BE LIABLE FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, CORRUPTION OF DATA, OR LOSS OF PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF INFORMATION AND PRODUCTS.

THE TOTAL LIABILITY OF DDG AND/OR ITS DEALERS, ASSOCIATES, AGENTS AND LICENSORS UNDER ANY PROVISION OF THESE TOU, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, SHALL BE LIMITED TO THE TOTAL DOLLAR AMOUNT ACTUALLY PAID FOR THE INFORMATION OR PRODUCTS GIVING RISE TO THE LIABILITY.

Return Policy
Any Product that is returned for a refund must be in the original packaging, undamaged and resalable.  All requests for refunds will be subject to a restocking fee and processing fee of twenty-five dollars ($25.00) or an amount deemed appropriate by DDG depending on the actual price of the product.  You are responsible for risk of loss, shipping and handling fees for returning Product. Some products marketed and sold by DDG are nonrefundable. Refund requests after 30 days from the purchase date will not be processed. No exceptions will be made to this policy unless another timeframe is specifically provided in the particular product marketing campaign.  If the Product return is subject to a money back guarantee, then a full refund will be issued as long as the product is in the original condition without wear and tear or any other damage. Shipping and handling charges will not be refunded on any Product returns including those subject to the money back guarantee.  

Event Refunds
All Boot Camp tickets are valid for three (3) years after the original date of purchase unless otherwise specified. You are solely responsible for contacting DDG to register for a boot camp.  If a Boot Camp ticket is included in a separate membership package, other time restrictions may apply, in which case the terms and conditions of the separate membership package agreement shall govern.   All Boot Camp tickets are nonrefundable.  If you receive a Team Pass as an incentive for investing in any Boot Camp ticket, then the Team Pass must be used in conjunction with that specific Boot Camp ticket.  A Team Pass has no monetary value and is only valid at the same Boot Camp that the ticket holder attends. If you confirm your attendance at any Boot Camp, then DDG will expect you to attend.  If you or your team member cannot attend a Boot Camp, then your or your team member must send a written cancellation to Team@ChampionsLiveFree.com at least fourteen (14) days in advance of the date of the Boot Camp (“Cancellation Period”).  There will be no refund or credit for cancellations made outside of the Cancellation Period.  Additionally, if you or your team member fails to cancel within the Cancellation Period, then you will be responsible for any fees incurred by failure to attend Boot Camp and/or the ticket(s) will be considered redeemed.  This policy also applies to Internet Marketing Workshops and Lifestyle Freedom Club Events.

Dates and locations of all Boot Camps, Lifestyle Freedom Club Events and Internet Marketing Workshops are subject to change at any time without notice from DDG. Such notices will be posted on the DDG website and/or will be e-mailed to you.  Boot Camp tickets and/or other event tickets may not be exchanged or transferred unless otherwise specified by DDG.

Cancellations
Requests for cancellation of any monthly billing must be in writing and mailed to Di Lemme Development Group, Inc. at 931 Village Boulevard, Suite 905-366, West Palm Beach, Florida 33409-1939 unless otherwise specified.  You may decide to cancel at any time, but charges will not be prorated.  You must cancel before your billing date in order to avoid a charge for the following month.

Lifestyle Freedom Club Memberships must be cancelled either by mail to the address listed above or on-line.  To cancel your Club membership on-line, you must log into the member area at www.LifestyleFreedomClub.net. It is the member’s responsibility to cancel the billing for his/her membership.  Your membership fees for the Lifestyle Freedom Club are nonrefundable.

Coaching Programs must be cancelled via mail to the address listed above or by e-mail to Team@ChampionsLiveFree.com. Coaching Programs may be cancelled at any time; however, the coaching fees are nonrefundable.  If you are not actively participating in your Coaching Program, including but not limited to coaching sessions, then DDG will offer you a thirty (30) day courtesy period to fully engage in your coaching. If you fail to reengage within this thirty (30) day period, then your Coaching Program will be deemed cancelled. DDG will not be responsible for cancellations sent via email, but are not received by DDG.

Bank Check Policy
A twenty-five dollar ($25.00) fee will be charged if your check payment is returned to DDG for any reason (i.e., insufficient funds, account closing, etc.).  DDG assumes no responsibility for fees, charges or any other penalty that may be imposed by your bank as a result of an unpaid check.

No Unlawful or Prohibited Use

As a condition of your use of the DDG website(s), you warrant to DDG that you will not use the website for any purpose that is unlawful or prohibited by the TOU. You may not use the DDG website in any manner which could damage, disable, overburden, or impair the website or interfere with any other party's use and enjoyment of the website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the DDG website.

 

Limitation On Use of Information

You agree to use content or information obtained from the DDG website only for your own private use or the internal purposes of your home or business. Under no circumstances, will you cause or permit any portion of the content or information on the DDG website to be published, printed, downloaded, transmitted, distributed, reengineered, or reproduced in any form for resale, republishing, posting on a web site, redistribution, or viewing unless otherwise provided by DDG.

 

Access Restriction

DDG reserves the right to terminate your access to the Information, products, services DDG websites and all related services at any time without notice. These terms of use constitute an enforceable legal agreement which is governed by the laws of the State of Florida in the United States of America. You hereby consent to the exclusive jurisdiction and venue of courts in Palm Beach County, Florida to hear and resolve all disputes arising out of or relating to the use of the products, services, information, and/or DDG websites. Use of the DDG products, services, information and/or the DDG websites is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and DDG as a result of this agreement or use of the products, services, information and/or DDG websites. DDG's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of DDG's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the products, services, or information provided to or gathered by DDG with respect to such use.

 

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified via written documentation, this agreement constitutes the entire agreement between the user and DDG with respect to the DDG products, services, and information.

Testimonials

DDG does not claim ownership of materials you provide to DDG, including testimonials regarding any product or service for review by visitors of the website (“Testimonial”).  However, by posting a Testimonial you are granting DDG permission to use your Testimonial in connection with promoting its products and services on the website.  You will not be compensated for your Testimonial and DDG is not required to use your Testimonial. DDG may remove your Testimonial at any time. DDG does not pay or provide incentives to anyone that provides testimonials either online or offline.

 

Lifestyle Freedom Club

If you are a member of the Lifestyle Freedom Club, then your membership is governed by these TOU.

 

Lifestyle Freedom Club Account

To register for the Club, you will have to create a member account and pay the membership fee.  As a condition to using such components of the Club website, you will be asked to register and select a password and screen name ("User ID"). You shall provide accurate, complete, and updated registration information. Failure to do so shall constitute a breach of this TOU, which may result in immediate termination of your account. You may not (i) select or use as a User ID a name of another person with the intent to impersonate that person; (ii) use as a User ID a name subject to any rights of a person other than you without appropriate authorization; or (iii) use as a User ID a name that is otherwise offensive, vulgar or obscene. DDG reserves the right to refuse registration of, or cancel a User ID in its sole discretion. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify DDG immediately of any breach of security or unauthorized use of your account. Although DDG will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of DDG or others due to such unauthorized use. All registration information provided by you shall be subject to DDG’s Privacy Policy or any successor thereto.

 

Use of Community Areas

The Lifestyle Freedom Club community areas include but aren’t limited to forums, chats, blogs, photo share, video postcards, and calendars. These community areas are designed to enable you to communicate with other Club members and sometimes individuals outside of the Club. You agree to use the community areas only to post, send and receive messages and material that are proper and related to the Lifestyle Freedom Club.

 

By way of example and not as a limitation, you agree that when using the community areas, you will not:

  • Directly or indirectly violate any laws or regulations.
  • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights including but not limited to the rights of privacy and publicity of others.
  • Collect and/or distribute information about other users including e-mail addresses without their consent.
  • Prevent any other user from using and enjoying the community areas.
  • Publish, post, upload, distribute or disseminate any inappropriate, pornographic, profane, defamatory, infringing, obscene, indecent or unlawful information.
  • Upload files or information that in any way violates any protection offered by intellectual property laws or another other laws that in someway protect the information unless you own or control the rights thereto or have received all necessary consents.
  • Upload files that contain viruses, corrupted files, etc. that may damage the Lifestyle Freedom Club and/or the operation of another user’s computer.
  • Advertise or offer to buy or sell any products and/or services unless such community area specifically allows such messages.
  • Conduct or forward surveys, contests, pyramid schemes or chain letters that provide absolutely no value to other users.
  • Repost and/or download any file posted by another user of the community areas that you know, or reasonably should know, cannot be legally distributed and should have never been posted by the other user.

DDG has regularly monitors the community areas, but cannot guarantee that every violation will be immediately detected. DDG reserves the right to review materials posted to all community areas and to remove any materials in its sole discretion. DDG reserves the right to terminate your access to any or all of the community areas and your Lifestyle Freedom Club membership at any time without notice for any reason deemed appropriate by DDG.

DDG recommends that you use caution when providing personal information about yourself or your family in any community area. DDG does not control or endorse the content, messages or information found in any community area. DDG specifically disclaims any liability with regard to the community areas and any actions resulting from your participation in any community areas. Posts, downloads and/or other forms of media do not necessarily reflect the views and opinions of DDG.
